Shortly after lawyer Jeff Gluck of the Gluck Law Firm P.C. representing Futura offered an update regarding the ongoing lawsuit against The North Face, the outdoors specialist has now delivered an official response.
The North Face begins the statement by noting that they did not initiate the lawsuit, outlining how any resemblance to Futura's "signature atomic element design was entirely coincidental." The VF Corporation-owned brand highlighted how it has "tried repeatedly to resolve our differences outside of the courts" with attempts to offer "contributions to non-profit organizations that support artists and the creative community." Revealing that they also tried to offer Futura a paid collaboration in the future, but "none" of the "good faith offers were entertained by Futura or his lawyer."

The North Face did not initiate this litigation against Futura. It is in fact Futura and his lawyer who instigated this lawsuit.
The FUTURELIGHT™ logo was conceived and designed entirely by our internal creative team, a group of artists themselves. Its intent was to represent the product’s nanospinning technology and our iconic geodesic dome tent. Futura was not consulted on the FUTURELIGHT™ project, and any resemblance to his signature atomic element design was entirely coincidental and not part of our internal design team’s inspiration.
Nevertheless, since the Fall of 2019, The North Face has tried repeatedly to resolve our differences outside of the courts. This included offers of contributions to non-profit organizations that support artists and the creative community, as well as a paid future collaboration. Unfortunately, none of these good faith offers were entertained by Futura or his lawyer.
The comments by Futura’s lawyer do not accurately represent the legal issues pending before the court.
